Terms of Service

Last updated

Effective date: 2026-10-01

These Terms of Service ("Terms") are an agreement between [COMPANY_LEGAL_NAME] ("MyChurch Africa", "we", "us") and the church or organisation that registers for the MyChurch Africa platform, and the people who use it on that church's behalf ("you"). By creating an account or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

1. The Platform

MyChurch Africa is a church management platform that includes member and household records, branches, gatherings and attendance, giving and finance tracking, sermons and announcements, SMS communication, reports, a public church website, and related APIs and mobile apps (the "Platform").

2. Accounts and administrators

  • You must provide accurate information and keep it up to date. You must be authorised to act for the church you register.

  • The person who creates a church becomes its owner and administrator. Administrators decide who can access the church's account, which roles they hold and which branches they can see, and are responsible for everything done under the church's account.

  • Keep your credentials secure, use a strong password, and tell us promptly about any unauthorised use. You are responsible for activity on your account.

3. Plans, subscriptions and payment

  • The Platform is offered under subscription plans. Each plan has its own price, billing currency and usage limits, which are shown when you subscribe.

  • Subscriptions renew for the billing period you choose unless you cancel before the renewal date. Fees are charged through our payment provider and may be subject to taxes and provider fees.

  • We may change plan prices or limits by giving reasonable notice; changes apply from your next billing period.

  • If a payment fails or a plan limit is exceeded, we may restrict features until the account is brought back in line.

4. SMS credit and sender IDs

  • SMS messages are paid for with prepaid units in an SMS wallet. A church can hold a church-wide wallet and separate wallets for its branches. Units are deducted when a message is queued, based on the message length and the current rate.

  • Units are used only for SMS on the Platform and are not redeemable for cash. Units are returned to the wallet they came from when a scheduled message is cancelled before it is sent. Otherwise purchased units are non-refundable unless required by law.

  • A sender ID must be approved before it can be used, and approval can be declined or withdrawn. You must not use a name that impersonates another person or organisation. Where a branch has its own sender ID, messages sent with it use that branch's wallet.

  • Delivery depends on mobile networks and third-party providers, so we cannot guarantee that every message is delivered or delivered on time.

5. Online giving and payments

Online giving and payments are processed by an independent payment provider. We are not a bank or a party to the gift itself: a gift is made to the church, and the church is responsible for how it is used, for any receipts required by law and for any refunds. Payment provider terms and fees apply, and we may hold or reverse a payment where needed to prevent fraud or comply with the law.

6. Your data

  • You keep ownership of the records and content you put on the Platform ("Your Data"). You give us the right to host, process and display it only as needed to provide the Platform, as described in our Privacy Policy.

  • You are responsible for having a lawful basis, including any consent required, for the personal information you collect about members, visitors, givers and contacts, and for the messages you send to them.

  • You are responsible for the accuracy of Your Data and for the access you give to others. Financial figures shown in reports are only as accurate as the records entered.

  • You can export your data using the tools the Platform provides while your account is active.

7. Acceptable use

You agree not to:

  • send spam, unsolicited bulk messages, or content that is unlawful, defamatory, abusive, deceptive or that promotes hatred or violence;

  • use the Platform to collect or store information you have no right to hold, or for fraud, money laundering or other unlawful activity;

  • attempt to access accounts, data or systems that are not yours, probe or disrupt the Platform, or bypass usage limits or security controls;

  • copy, resell, reverse engineer or build a competing service from the Platform, except as the law allows; or

  • use the API in a way that places an unreasonable load on the Platform.

We may remove content, limit messaging or suspend access where we reasonably believe these rules have been broken.

8. Availability and support

We work to keep the Platform available and secure but do not promise it will be uninterrupted or error-free. We may perform maintenance, and we may change or discontinue features, giving notice of significant changes where practical. Support is available at [CONTACT_EMAIL] and [SUPPORT_PHONE].

9. Suspension, cancellation and deletion

  • You may cancel your subscription at any time from the Platform. Access continues to the end of the paid period.

  • An administrator can request deletion of the church account. Deletion is scheduled after a 30-day grace period, during which the account can be reactivated. After that, the church's records are removed as described in our Privacy Policy.

  • We may suspend or terminate access immediately for a breach of these Terms, non-payment, legal requirements, or to protect the Platform or others.

10. Intellectual property

The Platform, including its software, design, trademarks and documentation, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription in accordance with these Terms. These Terms do not transfer any ownership of our intellectual property to you.

11. Third-party services

The Platform relies on third-party services such as payment processors, SMS providers and hosting. We are not responsible for their acts or omissions, and your use of them may be subject to their own terms.

12. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement. The Platform is a record-keeping and communication tool and does not provide legal, tax, accounting or pastoral advice.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Platform is limited to the fees you paid us for the Platform in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to indemnify us against claims, losses and costs arising from Your Data, your messages, your use of the Platform in breach of these Terms, or your breach of the law or of anyone's rights.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, notify church administrators. Continuing to use the Platform after the effective date means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of [GOVERNING_LAW]. The courts of that jurisdiction have exclusive authority over any dispute, unless the law where you live gives you rights that cannot be waived.
